 Passport Sailing Club Members: Unlimited rentals of full fleet included in membership. Must have BKB 101 certification.

RULES & REGULATIONS FOR RENTALS

1. A contract & deposit is required, along with full rental fee, prior to taking boat out.
2. Lessee must provide proper certification or knowledge of sailing.
3. Lessee must be minimum 25 years old.
4. Equipment shall be inspected prior to launch & upon return to docks.
5. In case of capsize, the occupants shall remain with the craft until rescue.
6. No alteration of rigging is permitted.
7. Adverse weather conditions or their impending approach is cause for return to docks.
8. Capacity of craft shall not be exceeded as stated & recorded above.
9. False statements regarding qualifications to handle equipment subject Lessee to rental & deposit fee loss, & immediate return of craft and equipment.
10. No Pets Allowed Onboard

BOATS MUST BE RETURNED WITHIN THE AGREED UPON RENTAL HOURS TO OBTAIN YOUR DEPOSIT.  CHECK OVER BOAT & EQUIPMENT PRIOR TO DELIVERY OF BOAT.   LESSEE IS LIABLE FOR ALL LOSSES AND DAMAGES TO BOAT & EQUIPMENT.  DAMAGES WILL BE PAID FOR PRIOR TO RETURN OF DEPOSIT.  TOWING CHARGES & LABOR ($50.00/hr. MINIMUM) IF LESSEE DESIRES OR DANGER IS IMMINENT AND LESSOR DEEMS IT NECESSARY.

Memorandum of Agreement made by and between Lake Lanier Sailing Academy, Inc., d/b/a Lanier Sailing Academy, Inc. (Lessor) and Lessee signed for the purpose of RENTING the following listed boat and/or equipment.

1. The Lessee certifies that all occupants of said boat are capable of swimming 50 yards and are at least six years of age.
2. At all times the craft is in the water, the occupants thereof and all persons using the craft shall be attired with properly fastened, Coast Guard approved life jackets as provided by Lanier Sailing Academy, Inc.
3. The boat at any time, at the discretion of the Dock Supervisor may be called or towed to shore. In such instances the Lessee shall receive a prorated refund of the consideration for the rental of said watercraft except upon a breach of any condition thereof.
4. Lessee warrants that he is experienced, qualified and competent to operate equipment leased to Lessee and agrees to operate same in a specified area in a careful and prudent manner at all times and will obey all rules governing use of said equipment. Lessee agrees not to allow equipment to be unattended.
5. The Lessee assumes full responsibility for loss or damage to boat and any equipment provided pursuant to this rental agreement, regardless of a determination of fault.
6. Lessee further certifies that he is 18 years of age or over, or has provided the Lessor proof in writing of parental consent to lease or use such watercraft. Such consent expressly guarantees to indemnify and does hereby indemnify and hold the Lessor harmless of, from, and against any and all injury, loss, cost, damages, attorneys fee and/or liability to person or property growing out of or resulting from the use of this boat and/or equipment by the Lessee, or in connection with this contract.
7. In the event of any collision, accident or casualty involving this boat, Lessee agrees to immediately furnish the Lessor with a complete written report from the appropriate law enforcement agency, including the name and addresses of all witnesses and parties involved.
8. Lessee agrees that there shall be no diving or swimming from the craft during term of rental agreement. Nor shall the watercraft be beached or ran aground.
9. Lessee agrees to pay the sums indicated as a rental fee for the watercraft indicated.
10. Breach of any of the conditions or instructions by Lessee is grounds for immediate termination of this rental agreement and the payment of the full rental fee of the agreed upon term shall be paid to the Lessor upon termination as liquidated damages for breach hereof. In the event of damage to or loss of the leased equipment, the Lessee shall be responsible for the cost of repair or replacement of said equipment over and above the damages resulting from a breach thereof.
11. Lessee agrees to hold harmless and indemnify Lessor against any and all injury, damages, loss, costs, fees, and liability to person or property of any kind no matter how arising or occasioned, whether to property or to persons, including Lanier Sailing Academy, Inc. and arising out of Lessee’s use of equipment and irrespective or comparative or contributory negligence of any other person.
12. Lessee acknowledges that he has examined the boat, motor, sails, and equipment described herein and know the condition thereof, and that same is in good condition and repair, and that all extra equipment items checked and priced on reverse side are aboard. Lessee agrees that he will return boat, motor, and equipment in good condition as when received, to place of business of the Lessor, and to pay immediately all charges due under this agreement.
13. Lessee agrees not to assign this agreement or sub-charter the boat or equipment without the consent of Lessor, in writing. The Lessee agrees that the boat shall be employed exclusively as a pleasure vessel for the sole and proper use of himself, his family and guests, during the term of the rental.
14. Lessee agrees that he will not use the equipment rented hereunder in violation or contravention of any municipal, county, state, or federal law, ordinance, or regulation.
15. Where the use of a pronoun would indicate a single sex, said use shall be equally applicable as masculine or feminine.
16. Lessee agrees that provisions of this agreement shall apply whether equipment is leased to him for a fee or is made available to him without any fee being paid by the Lessee.
17. Lessee agrees not to operate this boat beyond the confines of the following waters:

* LakeLanier (south of BrownsBridge), swim areas, ramp areas and unsafe locations
